1. Acceptance of Terms

By accessing and using the Copilot agent (“Service”) provided by KAMIND, you agree to comply with and be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must not use the KSA Service.

2. Description of Service

The Service is a Copilot agent designed to assist users with reviewing data from their own Microsoft log analytics and Security APIs. The service uses Microsoft Graph APIs, and Azure AI and may be subject to additional Microsoft terms and use. The KSA Service is available through the Microsoft Marketplace and requires additional services to be configured to access the necessary security data.  The KSA services are subject to these Terms.

3. License and Access

  • License Grant: KAMIND grants you a non-exclusive, non-transferable, limited license to access and use the Service for your internal business purposes.
  • License Grant: You grant KAMIND royalty free access to use your Microsoft security data for the KSA service to respond and answer your queriers and to improve the KSA service.
  • Restrictions: You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Service without prior written consent from KAMIND.

4. User Responsibilities

  • Account Security: You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your Microsoft account when using the service.
  • Compliance: You agree to use the Service only for lawful purposes and in accordance with these Terms.

5. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which can be found at https://www.kamind.com/privacy-policy. By using the Service, you consent to the collection and use of your information as outlined in the Privacy Policy.

6. Intellectual Property

All content, trademarks, service marks, trade names, logos, and icons are proprietary to KAMIND or its licensors. Nothing in these Terms grants you any right or license to use any trademark, service mark, logo, or trade name of KAMIND or any third party.

7. User Contributions

By sharing any content, you grant KAMIND a non-exclusive, royalty-free and perpetual right to use, reproduce, modify, adapt, publish and display such content in any media within the KAMIND organization. You represent and warrant that you own or otherwise control all of the rights to the content that you share, and that the content you share does not violate these Terms of Use and will not cause injury to any person or entity; and that you will indemnify KAMIND for all claims resulting in the content you share.

8. Termination

KAMIND reserves the right to terminate or suspend your access to the Service at any time, without notice, for conduct that KAMIND believes violates these Terms or is harmful to other users of the Service, KAMIND, or third parties, or for any other reason.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. You expressly agree that your use of the service is at your sole risk. KAMIND does not guarantee that the Service will be error-free or uninterrupted.

10. Limitation of Liability

In no event shall KAMIND be liable for any indirect, incidental, special, consequential, or punitive damages, warranty of fitness, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Service by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Oregon, without regard to its conflict of law principles.

12. Changes to Terms

KAMIND reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the Microsoft Marketplace. It is your responsibility to review these Terms periodically to stay informed of any changes. Changes to these Terms are effective when they are posted on this page.

Your continued use of the service after the posting of revised Terms means that you accept and agree to the changes. If you do not agree to the new terms, you must stop using the service.
